Governor Kemp Issues Executive Order Permitting eNotary for Real Estate Transactions

Great news for Georgia REALTORS® and their clients! On Tuesday, March 31, Governor Kemp issued an Executive Order permitting electronic notary.

The Georgia Supreme Court’s order on Friday permitted attorneys to participate in closings via remote access.  Today’s Executive Order completes the puzzle of Virtual Closings by allowing after-the-fact notarization and witness to be done in a remote online fashion.   Thus, with today’s Order, Virtual Closings can take place during this current Public Health State of Emergency.

Additionally, this order is good news for our commercial practitioners as well. It updates a prior order and allows for previously exempted projects to utilize third party plan reviews and inspections for a time period concurrent with the Governor’s State of Emergency. These newly eligible projects are: hospitals, ambulatory health care centers, nursing homes, jails, penal institutions, airports, buildings or structures that impact national or state homeland security, or any building defined as a high-rise building in the IBC.
