ADA Website Compliance Warning

It has come to our attention from our long-time partner, Pearl Insurance, that there have been several ADA Claims filed recently in regard to company websites.

According to AXA XL, which is Pearl Insurance’s program E&O carrier, insureds are receiving an email or phone call stating that their website has some ADA violations, together with a demand letter as a complaint.  These demands include requests for phone interview with the law firm to discuss existing violations.   The law firm, so far, has not filed these complaints with the court.   It has been confirmed that several firms that were targeted actually did not have ADA issues with their websites.

AXA XL is strongly advising its clients not to conduct any phone interviews and AXA XL will hire defense counsel to represent the insured’s interests.  The insured is then advised to contact their website company to make sure that they are compliant.
